Terms and conditions of service

These terms govern the purchase and use of the Motion Raw software, a desktop program for AI-assisted automated video editing, sold through www.motionraw.com. By completing a purchase, the customer confirms they have read and fully accepted this document.

1. Seller identification

The service is provided by José María Gil Rodríguez, tax ID 17768564Y, address C/ Santa Isabel de Aragón nº 4, 50420, Zaragoza (Spain), contact email info@motionraw.com.

2. Purpose and nature of the product

Motion Raw is a downloadable digital information product: a desktop application delivered electronically after payment is confirmed, via a download link and a licence key sent to the email provided at checkout.

The product is not delivered on a physical medium. Performance of the contract begins immediately after purchase, when the download link and licence key are sent.

3. Compatible operating systems

Motion Raw is distributed for Windows only. There is no version for macOS or Linux.

The customer is responsible for checking that their computer meets the requirements before buying. Incompatibility with operating systems other than those listed (including macOS), or with older versions, does not entitle the customer to a refund.

For smooth editing of long videos we recommend a computer with at least 8 GB of RAM and 10 GB free disk space. On Windows ARM, performance may be slightly lower than native Intel/AMD builds.

4. Price and payment

Prices shown on the website are in euros (€) and include applicable taxes. Payment is processed securely through Stripe Payments Europe, Ltd.; Motion Raw does not store card data on its servers.

The electronic invoice with the tax details the customer provides at checkout is sent automatically to the stated email after payment is confirmed.

5. Licence

Purchase grants the customer a personal, non-transferable, non-exclusive licence to install and use Motion Raw on one (1) single device. The licence is tied to the first computer on which it is activated, via a hardware fingerprint.

If the customer changes computer, they may request the licence to be unlocked by writing to info@motionraw.com from the email associated with the purchase. Support will release it so it can be activated on the new device.

Reselling, assigning, renting, decompiling, reverse engineering or redistributing the software or licence key, or sharing it with third parties, is expressly forbidden. Breach results in immediate revocation of the licence with no right to a refund.

6. Refund policy

Under article 103.m) of Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users (LGDCU), the right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium when performance has begun with the consumer’s prior express consent and with their knowledge that they thereby lose the right of withdrawal.

By confirming the purchase and accepting these terms, the customer:

1. Requests and expressly consents to immediate performance, receiving the download link and licence key by email instantly.
2. Acknowledges and accepts that, because performance of the service starts at that moment, they lose the 14-calendar-day right of withdrawal that normally applies to distance purchases.

Accordingly, once payment is complete, returns, partial refunds or cancellations will not be accepted, except in the following exceptional cases:

• Duplicate charge due to a payment-gateway error, duly evidenced.
• Repeated technical impossibility of delivering the product, not attributable to the customer’s computer, connection or configuration, and not resolvable by support within a reasonable time.

Any issue must be reported to info@motionraw.com with the order number and a detailed description of the problem.

7. Support and updates

Your purchase includes:

• All future updates of the program.
• Support by email and via the private Telegram group you are invited to in the welcome email.

Support is provided in Spanish, during business hours (Monday to Friday), with a reasonable target of a reply within 48 business hours. No specific resolution time is guaranteed.

8. Limitation of liability

Motion Raw is provided “as is”, with no warranty of fitness for a particular purpose beyond the features described on the website at the time of purchase. The seller is not liable for:

• Loss or corruption of original or generated video files; keeping backups is recommended.
• Indirect damages, loss of profit or loss of opportunity arising from use of the program.
• Occasional software errors that can be fixed by an update.

In any event, maximum liability to the customer is limited to the amount actually paid for the licence.

9. Changes to these terms

The seller reserves the right to change these terms to reflect legal, technical or commercial changes. Any change will be published on this page with its date and will apply only to purchases made after that publication. Licences bought earlier are governed by the version in force at the time of purchase.

10. Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute arising from the contractual relationship, the parties submit, with express waiver of any other forum that might apply, to the courts of the seller’s domicile, unless mandatory consumer law requires another competent forum.
