2. Purpose
These terms govern access to and use of the motionraw.com website and of the Motion Raw desktop software distributed through it. Accessing the site implies acceptance of the terms set out here. If you disagree with any of them, do not use the site.
3. Nature of the product and exclusion of the right of withdrawal
Motion Raw is a downloadable digital information product (digital content not supplied on a tangible medium). Performance of the contract begins immediately after payment is confirmed, when the download link and licence key are sent.
Because of that nature, it does not accept returns or refunds once the purchase is complete.
This exclusion is based on article 103.m) of Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users (LGDCU), under which the right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium when performance has begun and, where payment is due, the consumer has given prior consent to begin performance, has acknowledged that they thereby lose the right of withdrawal, and the trader has provided the confirmation required by articles 98.7 or 99.2 of the same law.
By buying Motion Raw, the user expressly accepts these terms of service, requests immediate performance and acknowledges that, once performance begins, they lose the 14-calendar-day right of withdrawal provided for distance purchases.

4. Terms of use of the site
The user undertakes to use the site and its contents lawfully, in accordance with applicable law, these terms, morality, good customs and public order. In particular, it is forbidden to:
- Use the site for unlawful or harmful purposes, or in ways that may damage the image or interests of the owner or of third parties.
- Introduce or spread viruses, malware or any other element that may alter the normal operation of the site.
- Gain unauthorised access to systems or networks linked to the site, or obtain or attempt to obtain information, data or content without a right to it.
- Reproduce, copy, distribute, transform or modify the site’s contents without the owner’s express authorisation, except where legally permitted.
5. Intellectual and industrial property
All contents of the site (texts, photographs, graphics, images, icons, technology, software, as well as its graphic design and source code), and the trademarks, trade names or distinctive signs, belong to José María Gil Rodríguez or, where applicable, to the rights holders who have authorised their use. All rights are reserved.
Any use not expressly authorised will be treated as an infringement of the owner’s intellectual or industrial property rights and may give rise to the corresponding legal action.

The site may contain links to external websites (for example the Stripe payment gateway, the Telegram support group or official third-party documentation). Accordingly, the owner will not be liable for any damage that may arise from such circumstances, except where acting with wilful misconduct or gross negligence, as required by law.

9. Governing law and jurisdiction
These terms are governed by Spanish law. For any dispute arising from access to or use of the site, the parties, with express waiver of any other forum that might apply, submit to the courts of Zaragoza, unless mandatory consumer law requires another forum.
