Privacy policy

At Motion Raw we take the protection of your data seriously. This policy explains, in plain language, what information we collect, what we use it for, who we share it with and what rights you have, under Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on Personal Data Protection and guarantee of digital rights (LOPDGDD).

1. Data controller

2. What data we process

We collect only the data strictly needed to provide the service:

a) Data provided at purchase

  • First and last name.
  • Email address.
  • Billing data: tax address, tax ID and country (when you provide them in the Stripe form).
  • Transaction data: amount, date and internal order reference. We do NOT store card data: Stripe processes it directly.

b) Data generated when the licence is activated

  • Device fingerprint (an identifier derived from the hardware) to tie the licence to a single computer.
  • IP address from which activation is performed.
  • Computer name and operating system (informational, shown in your support account).
  • Date and time of activation.

c) Communication data

  • Content of emails you send to support.
  • If you join the private Telegram group: your Telegram username or public name (handled by that platform).

d) Browsing data

The public site www.motionraw.com does not use tracking cookies, Google Analytics or advertising pixels. The server records basic access logs (IP, date, requested URL) for security and diagnostics, for a maximum of 30 days.

3. Why we use it (purposes)

  • Process your purchase and deliver the product (download link + licence key).
  • Generate and send your electronic invoice.
  • Validate licence activation and tie it to the authorised device.
  • Handle your queries, incidents and support requests.
  • Meet applicable legal obligations (accounting, tax, commercial).
  • Send operational communications about the product (updates, security notices). We do not send advertising or commercial newsletters without your express consent.

4. Legal basis

  • Performance of the contract (art. 6.1.b GDPR): to deliver the software, manage the licence and provide support.
  • Compliance with legal obligations (art. 6.1.c GDPR): retention of invoices and tax data.
  • Legitimate interest (art. 6.1.f GDPR): service security, fraud prevention and the licence anti-piracy system.
  • Consent (art. 6.1.a GDPR): where applicable, to send commercial communications you expressly request.

5. How long we keep your data

  • Purchase and billing data: at least 6 years, under the Commercial Code (art. 30) and applicable tax rules.
  • Licence and activation data: while the licence is active and, afterwards, for the limitation period of possible legal claims (up to 5 years).
  • Support communications: up to 3 years from the last interaction.
  • Server logs: up to 30 days.

6. Who we share your data with

Your personal data is not sold or transferred to third parties for commercial purposes. We only work with the providers strictly needed to deliver the service, all of them as processors under a signed contract (art. 28 GDPR):

Stripe

  • Stripe Payments Europe, Ltd. (Ireland).
  • Processes the payment and charges your card.
  • PCI-DSS level 1 compliant.
  • Policy: stripe.com/privacy

Brevo (Sendinblue)

  • Sendinblue SAS (France).
  • Sends the welcome email with licence and download links.
  • Servers in the European Union.
  • Policy: brevo.com/legal/privacypolicy

Hosting

  • The site owner’s web-hosting provider.
  • Servers in the European Union.
  • Hosts the website, the licence database and technical logs.

Telegram (optional)

  • If you choose to join the private support group.
  • Telegram FZ-LLC (United Arab Emirates).
  • Use is voluntary; your privacy on Telegram is governed by its policy.
  • Policy: telegram.org/privacy

We may also disclose your data to competent authorities (tax agency, law-enforcement, courts) when there is a legal obligation to do so.

7. International transfers

The main providers (Stripe, Brevo and hosting) process your data in the European Union or in countries declared to have an adequate level of protection by the European Commission. Where a provider may process data outside the EEA, the standard contractual clauses approved by the European Commission are used as an additional safeguard.

8. Your rights

As a data subject, you may at any time exercise the following rights over your data:

  • Access: know what data we hold about you.
  • Rectification: correct inaccurate or incomplete data.
  • Erasure (β€œright to be forgotten”): delete your data when it is no longer needed for the purpose it was collected for.
  • Objection: object to processing based on legitimate interest.
  • Restriction of processing: ask that data only be stored, not processed.
  • Portability: receive your data in a structured, commonly used format.
  • Withdraw consent where processing is based on it, without retroactive effect.

To exercise any of these rights, write to info@motionraw.com with the subject "Data protection" and attach a copy of your ID or equivalent document to prove your identity. We will reply within one month at most.

You also have the right to lodge a complaint with the competent supervisory authority, which in Spain is the Spanish Data Protection Agency (www.aepd.es), if you consider that the processing of your data does not comply with the law.

9. Security measures

We apply appropriate technical and organisational measures (encryption in transit via HTTPS/TLS, access control, regular backups and activity logging) to ensure the confidentiality, integrity and availability of your data, and to prevent unauthorised alteration, loss or processing.

10. Minors

The service is not directed at children under 14. We do not knowingly collect data from minors. If we detect that a minor has provided data without parental or guardian consent, we will delete it immediately.

11. Cookies

The site does not use third-party cookies for analytics or advertising. It may only use strictly necessary technical cookies for the checkout form to work (secure Stripe session). Those cookies are exempt from consent under article 22.2 LSSI.

12. Changes to this policy

We may update this policy to reflect legal changes or service improvements. The current version will always be available at this same URL, with the date of the last update at the top of the document.
